Utah Driving Privilege Card: Who Can Get One, What You Need, and What It Is Not

General information, not legal advice. Read the full disclaimer.

Short answer: A driving privilege card is a Utah Driver License Division card for people who cannot prove lawful presence in the United States but who qualify to drive in Utah. Utah Code § 53-3-205 says applicants for a card don't have to show lawful presence (the lawful-presence requirement applies to regular licenses), and they can use a Social Security number, written proof they are ineligible for one, or an Internal Revenue Service temporary identification number (ITIN) if they don't qualify for a Social Security number. The card must be marked "FOR DRIVING PRIVILEGES ONLY — NOT VALID FOR IDENTIFICATION," it expires on your birth date in the first year after issuance, and first-time applicants must submit fingerprints and a photograph (§§ 53-3-205, -205.5, -207). The Division can't issue a temporary card, though it may issue a learner permit to a card applicant.

Who this guide is for

Utah residents who can't get a regular driver license because they lack documents proving lawful presence, and their families. Driving without a valid license or insurance is a crime and can lead to major problems. This guide is about Utah's driver-licensing statutes only; it isn't immigration legal advice, and rules and procedures can change, so check with the Utah Driver License Division for the current checklist and appointment requirements.

Key requirements in the statute

Identity basicsProof of name, birth date and birthplace (for example a current license, birth certificate or other proof the Division accepts)

TestingApplicants take the knowledge and driving tests as other drivers do; contact the Division for details

The statute also says the card carries the same kinds of information as other licenses (number, name, birth date, Utah address, description, photo, signature, restrictions).

What the card is not

  • It is not an ID card: it can't be used as identification.
  • It does not give any immigration status or protection.
  • It doesn't remove other requirements, such as auto insurance, registration, or following traffic law. See Utah Traffic Tickets and Points.
  • A card can be suspended or revoked like a license. See Driving on a Suspended License in Utah.

Practical tips

  1. Check the Division's website for the current list of documents, fingerprint vendors and testing steps.
  2. Get fingerprints from an approved vendor or law enforcement agency and keep the sealed envelope sealed.
  3. Get car insurance before driving; Utah requires coverage. See Utah Auto Insurance Requirements.
  4. Don't drive unlicensed. A stop for driving without a license can lead to a citation or arrest. See Utah Arrest Warrants.
  5. Talk to an immigration attorney or accredited representative about your situation. See Free and Low-Cost Immigration Legal Help in Utah.
