Juab County Criminal Cases: Nephi Courts, Jail, and Court-Appointed Lawyers

General information, not legal advice. Read the full disclaimer.

Short answer: In Juab County, misdemeanor and traffic cases are generally heard in the Juab County Justice Court at 160 North Main Street, Nephi (435-623-3440), and felonies and more serious matters go to the Fourth District Court in Nephi (the Utah Courts contact listing is 102 E 200 N, Nephi; 435-623-0901). The Juab County Sheriff's Office is at 425 West Sheeplane Drive, Nephi (435-623-1344). If your charge carries possible jail, the court must tell you of your right to counsel by your first appearance and decide whether you qualify as indigent — income at or below 150% of the federal poverty level, or unable to pay a lawyer without giving up basic necessities — and so entitled to an appointed lawyer (Utah Code §§ 78B-22-201, -202, -203).

Because the information above comes from county and court pages that can change, verify the address and hours with a call. Also check whether your citation names a different court — a stop on I-15 or U.S. 6 by Utah Highway Patrol may be filed in the court for the area where the stop happened.

Getting a lawyer you can't afford

  • Right to counsel applies when the penalty could include incarceration, and the court must advise you no later than the first appearance (§ 78B-22-201).
  • Indigency means income at or below 150% of the federal poverty guidelines, or inability to pay for counsel and expenses without depriving yourself or your family of food, shelter, clothing or other necessities (§ 78B-22-202).
  • How to ask: tell the judge at your first appearance and complete the affidavit the court provides. The Justice Court's website has a Declaration of Financial Status form to download, fill out (all three pages) and email to the court at JCJUAB@UTCOURTS.GOV; the judge reviews it and notifies you.
  • Who represents you: a provider with the county's indigent defense system, assigned by the judge (§ 78B-22-203). You can't pick the attorney.
  • Smaller counties sometimes have fewer lawyers locally. If you want to hire a private lawyer, see How to Find Free or Low-Cost Legal Help in Utah and Public Defender Eligibility in Utah.
